Notice is hereby given that the following foreign will or affidavit of heirs has been filed in the Preston County Clerk’s Office at 106 West Main Street, Suite 103 Kingwood, WV 26537‐1131, and no appointment or administration is being made pursuant to the provisions of West Virginia Code 44‐1‐14b.

An interested person(s) objecting to the filing of the foreign will or affidavit or objecting to the absence of appointment or administration being made in this state must file a statement with the Preston County Commission through the County Clerk’s Office at the address listed above within 60 days after the date of first publication or 30 days of service of the notice, whichever is later. If an objection is not timely filed, the objection is forever barred.

The Preston County Commission upon receiving any timely objection thereto shall schedule a hearing or hearings thereon and order relief, if any, it considers proper including, but not limited to, an order directing that full and complete ancillary administration of the estate of the nonresident decedent be made in this state.

BEGINNING at an Iron Pin standing in the division line between lots 12 and 13 of said Kembles Addition, and at the south cast corner of the lot now owned and occupied by Wm. L. Lenhart, and the north east corner of the lot herein conveyed; thence with the original line dividing Lots 12 and 13, S. 3-15′ W. 54 feet, more or less to a stake, north east corner of lot owned by Crawford Scott, and with his line N. 86-45′ W. 126.2 feet, more or less, to the East line of Morgantown Street, and with same, N. 30-35′ W. 68.4 feet, more or less, to the south west corner of WI. L. Lenharts’ lot, and with the same, S. 85-45′ E. 164.6 feet, more or less, to the place of beginning. 

And being the same real estate conveyed to Joseph H. England and Ruth Ann England, husband and wife, from Clair Wilkinson and Mary Wilkinson, husband and wife, by deed dated the 3rd day of April, 1986, of record in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book 524, at page 843, to which deed reference is here made for all pertinent purposes. 

The said Ruth Ann England died on May 4, 2019 and, by virtue of the survivorship provisions in the aforesaid deed, title to the above-described real estate vested in Joseph H. England. The said Joseph H, England died testate on May 30, 2019, and by the terms of his Last Will and Testament recorded in the aforesaid Clerk’s office in Will Book 85, at page 403, he devised the above-described real estate to Jeannie Ridenour and Leonard Ridenour and further granted to his Executrix,Jeannie Ridenour, the power to sell the above-described real estate. 

This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title. 

1) The property will be conveyed in “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1. 

3) The Beneficiary and/ or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 

4) The Tmstee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in tl1e sole discretion of the Trustee. 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property. 

6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.

NOTICE IS HEREBY given that the County Commission of Preston County, West Virginia will be in session at the Preston County Commission Meeting Room, 103 North Price Street, Kingwood, WV for the purpose of reviewing and equalizing the assessments of Preston County for the Year 2021 as returned by the Assessor thereof, on the following dates at the time there in specified, and if necessary, at other dates to be determined by the Commission at a later date:

Any person who is a taxpayer of ad valorem property taxes in any West Virginia county may protest an appraisal of property under this article for good cause alleged and shown.  A person desiring to protest a reappraisal of property shall petition for a hearing before the administrative appraisal review board in the same manner as an owner would petition for hearing with regard to the appraisal of his property under the provisions of subsection (a) of this section: Provided, that a petition for protest must be filed with the county commission within forty-five days after publication of the notice required in subsection (a) section [s 11-1A-16 (a)] of this article.

All persons believing their real or personal taxation to be improper are invited to be present at one of the above stated times to make their requests for relief known.

If any person fails to apply for relief, on or before February 20, 2021 [s 11-3-24 (b)], he shall have waived his right to ask for correction in this assessment list of the current year and shall not thereafter be permitted to question the correctness of his list as finally fixed by the County Commission, except on appeal to the Circuit Court.
