NOTICE OF SALE OF REAL ESTATE
WHEREAS, by deed of trust dated April 26, 2011, of record in Volume 1080 at page 884 in the Register’s Office of Dickson County, Tennessee (the “Deed of Trust”), David Thomason, Jr. conveyed the hereinafter-described real estate (the “Property”) to Barney B. Regen, Trustee (the “Trustee”), to secure the payment of the indebtedness evidenced by a promissory note of even date therewith executed by the grantor and made payable to First Federal Bank, together with all renewals, extensions, and modifications thereof (collectively, the “Note”); and
WHEREAS, default has occurred in the payment of the Note and other provisions of the Deed of Trust have been violated, and First Federal Bank, the owner and holder of the Note, has declared the entire indebtedness due and payable, and has directed the Trustee to foreclose the Deed of Trust in accordance with the terms thereof;
THE PUBLIC IS HEREBY NOTIFIED that the Trustee will sell the Property at public auction to the highest and best bidder for cash at the front door of the Dickson County Courthouse Annex in Charlotte, Tennessee, at the hour of 3:00 p.m. prevailing central time on Friday, December 11, 2020, in bar of the Grantor’s right and equity of redemption, and subject, inter alia, to all liens, encumbrances, and other defects in title having priority or preference over the Deed of Trust; to the rights of tenants in possession, if any; and to all applicable and enforceable laws of governmental authorities having jurisdiction of the Property, whether or not such matters are disclosed by the public records of the county wherein the Property is located.
The Property is described in the Deed of Trust as follows:
Lying and being in the Thirteenth Civil District of Dickson County, State of Tennessee, and being Lot 2 of a division of the property as shown on the plat of record in Cabinet B, Slide 224, in the Register’s Office of Dickson County, Tennessee, and being more particularly described as follows:
Lot 2: Beginning on a point in the centerline of Oaktree Lane, the Southwest corner of Lot 1 and the Northwest corner of this tract; thence with the South boundary of Lot 1, South 84 degrees 32 minutes 51 seconds East 91.53 feet to an iron pin, the Southeast corner of Lot 1 and in the West boundary of Bellar; thence with the West boundary of Bellar, South 6 degrees 25 minutes 45 seconds East 648.72 feet to a fence post, Bellar’s Southwest corner and the Northwest corner of Travis, and also the Northeast corner of a 7.99 acre tract; thence with the North boundary of the 7.99 acre tract, North 50 degrees 31 minutes 55 seconds West 314.32 feet to a point in the centerline of Oaktree Lane; thence with the centerline of Oaktree Lane, North 36 degrees 44 minutes 32 seconds East 79.51 feet to a point; thence North 30 degrees 36 minutes 49 seconds East 215.8 feet to a point; thence North 17 degrees 29 minutes 53 seconds East 106.48 feet to the point of beginning, containing 2.28 acres, more or less, by survey of J. S. Brenner, Tennessee Registered Land Surveyor No. 980, dated January 3,1992.
Also conveyed herewith is a 1995 Apollo Mobile Home, 56 x 14, serial Number CLA035577TN, which is permanently attached to the property and is made a part thereof.
Being the same property conveyed to David Thomason, Jr. by deed from Ronald D. Murphy dated April 26, 2011, of record in Volume 1080 at page 882 in the Register’s Office of Dickson County, Tennessee
The Property is subject to the right-of-way of Oaktree Lane.
The Property is subject to all matters shown on a plat of record in Plat Cabinet B, Slide 224, in the Register’s Office of Dickson County, Tennessee.
The street address of the Property is believed to be 145 Oaktree Lane, Dickson, Tennessee, but such address is not part of the legal description by which the Property will be sold, and in the event of a discrepancy between the legal description and the street address, the legal description will control.
The Property is believed to be identified as Map 123-00-036.14 on the Dickson County tax map.
The Property is believed to be improved.
The right is reserved to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the sale above; to adjourn the sale of the Property to another time and place without further publication upon announcement of such adjournment at the time and place set for the adjourned sale; and to repeat this process from time to time until the Property is sold by the Trustee, or until the expiration of one (1) year following the originally scheduled date of sale, whichever occurs first.
The right is reserved to cancel the sale of the Property at the request of the secured creditor, and to re-advertise the Property for sale at a later date, without diminishing, impairing, or otherwise affecting the priority of the Deed of Trust as a lien on the Property.
If the highest bidder does not pay the bid price within twenty-four (24) hours of the sale, the right is reserved to sell the Property to the next highest bidder who is ready, willing, and able to purchase the Property for cash.
The record owner of the property is David Thomason, Jr..
There is no record holder of any mortgage, deed of trust, or other lien which will be extinguished or adversely affected by the sale of the Property, and which mortgage, deed of trust, or lien, or notice or evidence thereof, was recorded in the public records of Dickson County, Tennessee, more than ten (10) days prior to the first advertisement or notice of sale.
The Trustee is unaware of any other party whose rights will be adversely affected by the sale of the Property pursuant to this notice.
The Trustee is considered a debt collector within the meaning of the Fair Debt Collection Practices Act. Accordingly, this notice is from a debt collector attempting to collect a debt and any information obtained will be used for that purpose.
